NEW DELHI: The NIA has not invoked the Unlawful Activities (Prevention) Act (UAPA) in its chargesheet against six Ukrainian nationals and a US citizen in a case registered under the anti-terror law in April. The chargesheet instead invokes sections 21 and 23 of the Immigration and Foreigners Act, 2025.The chargesheet said the accused had valid travel documents but didn’t obtain the mandatory Protected Area Permit (PAP) required to enter Mizoram. NIA said its probe into the UAPA aspect remains underway and a supplementary chargesheet may be filed if an offence is established. Special judge Prashant Sharma will consider the chargesheet on Oct 1.American citizen VanDyke and Ukrainian nationals Kaminskyi Viktor, Hurba Petro, Slyviak Taras, Ivan Sukmanovskyi, Stefankiv Marian, and Honcharuk Maksim were arrested in March at various airports for allegedly travelling to Mizoram without the required permits and crossing into Myanmar.

An FIR was registered against them under UAPA over their suspected links to armed groups in Myanmar, where multiple militant organisations active in North-East India maintain bases. Earlier, NIA had told the court that the foreigners were being probed for a wider terror conspiracy, including allegedly assisting ethnic armed groups in India and Myanmar and imparting drone training to them.The chargesheet traced their movement from India to Myanmar from Dec 2025. They travelled from Mumbai to Guwahati and then to Mizoram without the requisite permit before crossing into Myanmar. Another group of Ukrainians arrived in New Delhi in Dec, travelled to Guwahati and then went to Mizoram to cross over to MyanmarVanDyke reached Delhi on Dec 12, 2025, travelled to Guwahati and stayed there till Dec 27 before visiting Mizoram without the requisite permit. Believed to be part of America’s “deep state”, VanDyke is the founder of Sons of Liberty International, a non-profit security firm that reportedly provides training to groups fighting authoritarian regimes.
